Agreement to Terms
By downloading, installing, or using the UpCanyon mobile application ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms are a legal agreement between you and UpCanyon LLC ("UpCanyon," "we," "our," or "us").
What UpCanyon Is
UpCanyon provides weather conditions, forecasts, webcams, snowpack, streamflow, reservoir, air-quality, and alert features for outdoor recreation across the United States, with the deepest coverage in Colorado's Front Range. The App aggregates data from government agencies, public networks, and licensed providers to help you decide when and where to get outside.
No Account Required
The App does not use accounts. Your preferences, pins, and lists live on your device. If you enable alerts, your alert rules are stored on our servers under an anonymous install identifier (see the Privacy Policy). Purchases are tied to your Apple or Google store account — not to anything of ours — which is also how they restore on a new device ("Restore Purchases" in Account).
Because there is no account, there is nothing to sign into and nothing to be locked out of. It also means that if you delete the App and its data without an active store subscription record, we have no way to recover your pins and settings.
Subscriptions and Payments
Plans
UpCanyon offers a free tier and a premium subscription ("UpCanyon Pro") with additional features including unlimited pinned spots and alerts, advanced alert targeting, multi-year history, and Cast View.
Current purchase options:
- Monthly: $4.99 per month
- Annual: $29.99 per year
- Lifetime: $99.00 one-time purchase (same features as Pro, paid once)
Prices may change; existing subscribers will be notified before an increase affects their renewal.
Free Pro Period for New Installs
Every new install includes 7 days of UpCanyon Pro at no cost. No payment method is collected, nothing renews, and you are never charged automatically — when the 7 days end, the App simply returns to the free tier unless you choose to subscribe.
If we ever offer a store-billed free trial in the future (started through the App Store or Google Play with a payment method on file), its auto-renewal terms will be disclosed at the point of purchase and can be canceled in your store account settings before the trial ends.
Billing
All payments are processed by the Apple App Store or Google Play. By subscribing you also agree to their terms.
- Paid subscriptions renew automatically unless canceled at least 24 hours before the end of the current period
- Renewal is charged within 24 hours before the current period ends
- Manage or cancel anytime in your device's subscription settings
- Uninstalling the App does not cancel a subscription
Refunds
Refunds are handled by Apple or Google under their policies — contact App Store or Google Play support.
Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Reverse engineer, decompile, or extract source code from the App
- Interfere with or disrupt the App's servers or networks
- Scrape, re-serve, or redistribute webcam images or aggregated data from the App
- Build automated systems or bots against the App or its backend
- Use the App in a way that harms other users or the data providers it relies on
We may terminate access for violations of these Terms.
Intellectual Property
Our content
The App — its design, code, branding, and original content — is owned by UpCanyon LLC and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without written permission.
Third-party content
Weather data, webcam imagery, and other content displayed in the App come from third-party providers, including but not limited to: the National Weather Service / NOAA, USGS (stream gauges and HIVIS flood cameras), USDA NRCS SNOTEL, the U.S. Bureau of Reclamation, EPA AirNow, the Iowa Environmental Mesonet, WeatherAPI, Tempest / WeatherFlow, the Colorado Avalanche Information Center and other avalanche centers, state departments of transportation and 511 traveler-information systems (including CDOT, UDOT, WSDOT, Caltrans, NYSDOT/511NY, Nevada 511/NDOT, Wisconsin 511/WisDOT, Georgia 511/GDOT, Idaho 511/ITD, Arizona 511/ADOT, WYDOT, the Montana Department of Transportation, the Kentucky Transportation Cabinet, the Iowa DOT — whose camera data is used under a Creative Commons Attribution 4.0 license — and Tri-State / New England 511, the data provider for MaineDOT, NHDOT, and VTrans cameras, among others; DOT data is provided “as is” with no warranty by the issuing agency), the National Park Service, the FAA weather camera program, ALERTWildfire, Viaero Wireless, universities and research networks (including USDA ARS and PhenoCam), and municipal, county, and community webcam operators. Attribution is shown in the App alongside each source.
UpCanyon does not own, operate, or control any third-party webcam or data feed. All feeds are provided by independent operators and displayed for informational purposes. We make no representations about the ownership, accuracy, or continued availability of any specific feed, and you may not redistribute, sell, or commercially exploit third-party content obtained through the App.
Colorado Department of Transportation (CDOT) data
The following disclaimer is required by CDOT's Terms of Service and applies to all CDOT-sourced data displayed in the App:
“The data made available here has been modified for use from its original source, which is the State of Colorado, Department of Transportation (CDOT). THE STATE OF COLORADO AND CDOT MAKES NO REPRESENTATIONS OR WARRANTY AS TO THE COMPLETENESS, ACCURACY, TIMELINESS, OR CONTENT OF ANY DATA MADE AVAILABLE THROUGH THIS SITE. THE STATE OF COLORADO AND CDOT EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. The data is subject to change as modifications and updates are complete. It is understood that the information contained in the Web feed is being used at one's own risk.”
Your feedback
If you send feedback, bug reports, or ideas, you grant UpCanyon a non-exclusive, royalty-free license to use them to improve the App.
Safety Disclaimers
Weather information
THE APP PROVIDES WEATHER INFORMATION FOR INFORMATIONAL PURPOSES ONLY. Conditions change rapidly and can differ from what is displayed.
You acknowledge that:
- Weather data may be delayed, inaccurate, or unavailable
- Webcam images may be outdated or offline
- Avalanche, streamflow, snowpack, and air-quality data are estimates, not guarantees
- Mountain and backcountry environments are dangerous and unpredictable
Always check multiple sources, exercise your own judgment, be prepared for conditions worse than forecast, and follow official guidance (NWS, avalanche centers, land managers, local authorities).
Alerts are best-effort — not a life-safety system
Alert delivery depends on Apple/Google push infrastructure, your device settings, and network availability, and may be delayed or fail entirely. Never rely on UpCanyon as your sole source of severe-weather warnings. Wireless Emergency Alerts (WEA) and NOAA Weather Radio are the authoritative warning channels; keep them enabled.
No professional advice
The App does not provide professional meteorological, safety, or emergency services advice. Do not rely solely on the App for decisions that could affect your health or safety.
Service availability
We work to keep the App accurate and available, but we do not guarantee uninterrupted access, error-free operation, or the availability of any specific webcam or data source. Feeds may go offline, be blocked, or be discontinued at any time without notice. Your subscription buys access to the UpCanyon application and its aggregation features — not to any specific third-party feed.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
UPCANYON LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Personal injury or property damage
- Lost profits or data
- Decisions made based on App information (including alerts that did not arrive)
- Inability to access the App
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $50, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; where those laws apply to you, some limitations may not.
Indemnification
You agree to indemnify and hold harmless UpCanyon LLC, its officers, employees, and agents from claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, your violation of another party's rights, or outdoor activities undertaken based on information from the App.
Termination
You may stop using the App at any time; "Reset app data" clears your device, and canceling any subscription happens in your store account. We may suspend or terminate access at any time, with or without cause or notice — for example for violations of these Terms or abuse of the backend. Provisions that should survive termination (disclaimers, limitation of liability) survive.
Changes to Terms
We may modify these Terms. Material changes will be posted in the App, and continued use after changes means you accept them. If you do not agree to modified Terms, stop using the App and cancel any active subscription.
Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Larimer County, Colorado, and you consent to their jurisdiction.
General
These Terms plus the Privacy Policy are the entire agreement between you and UpCanyon about the App. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor.
Apple-Specific Terms
If you downloaded the App from the Apple App Store:
- These Terms are between you and UpCanyon LLC, not Apple Inc.
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for product warranties or any claims related to the App
- Apple is a third-party beneficiary of these Terms
Google-Specific Terms
If you downloaded the App from Google Play:
- These Terms are between you and UpCanyon LLC, not Google LLC
- Google has no obligation to provide maintenance or support for the App
- Google is not responsible for product warranties or claims
